• Obtain parental or guardian consent if under the legal age
• Provide accurate age information and necessary consents
• Maintain the confidentiality of their account credentials and are fully accountable for all activities that occur under their account

Service Description

Headshot Express uses AI technology to generate professional headshots from user-uploaded photos. The service allows users to choose from several plans. Detailed information about pricing is available on our website, and such information may be updated from time to time.

Payments and Refunds

Payments for paid packages can be made through the available methods on our website, including credit or debit cards and other third-party payment processors that comply with industry standards for security. Refunds are available if requested within 14 days of purchase, provided that no photos have been downloaded or used in any way.

Users are only elligible to refund as long as they do not perform any action that are against this Terms and Conditions.

Refund requests should be directed to our customer support team at [email protected] or via contact form on our website. Users must notify us of any billing issues or disputes within 7 days of the charge. Failure to notify within this period may result in the waiver of the right to dispute the charge.

Privacy and Data Protection

Headshot Express collects personal information at various points during the user's interaction with our services, including sign-up and usage of services. This information includes email addresses, IP addresses, and other necessary data. The data collected is utilized to provide and enhance our services, communicate with users, and comply with legal obligations.

Headshot Express will not resell user-created headshots or assert any copyright claims against users or their end-users.

No Guarantees and Limitation of Liability

The Service is provided "AS IS" and "AS AVAILABLE". Headshot Express makes no guarantees regarding the operation or functionality of the Service, the accuracy or reliability of the content generated, or the availability of the Service at any given time.

Headshot Express is not liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of the Service, even if we have been advised of the possibility of such damages. Our total liability for any claims arising out of or relating to the Service is limited to the amount paid by you to Headshot Express for the Service in the 12 months preceding the claim. Users are responsible for ensuring their use of the service complies with their local laws.

Indemnity

Users agree to indemnify and hold harmless Headshot Express, its affiliates, officers, agents, and employees against any claims, damages, losses, liabilities, and expenses, including reasonable legal fees, arising from or related to their use of the Service, violation of these Terms, or infringement of any intellectual property or other rights of any person or entity.

Termination

We reserve the right to terminate a user's access to the Service for violations of these Terms, our Content Policy, or any applicable laws. Termination may be immediate and without prior notice. Upon termination, all rights granted to the user under these Terms will cease, and the user must cease all use of the Service and delete any content obtained through the Service.

Governing Law

These Terms are governed by and construed in accordance with the laws of Germany, without regard to its conflict of laws principles. Users agree to submit to the exclusive jurisdiction of the courts located in Germany for any disputes arising out of or relating to these Terms or the use of the Service.

Arbitration

Any disputes arising out of or related to these Terms or the Service will be resolved by binding, individual arbitration under the rules of the German Arbitration Institute (DIS). Users waive their right to a jury trial or class action. The arbitration will take place in Germany. The arbitrator's decision will be final and binding, and judgment on the award may be entered in any court with jurisdiction.
